ECJ Has Ruled in Favor of Online Gambling Operators
It was once again ruled by the European Court of Justice (ECJ) that national regulators are not permitted to treat online gambling operators from other nations within the European Union differently than those in their own countries who want to enter into their gambling markets.
According to the ECJ, it is against European Union legislation for national laws to favor the market spot of incumbents who are under the pretense of fraud prevention or consumer protection. In other words, national regulators of internet gambling markets can no longer discriminate against new operators and must provide them with the same fair market access, eliminating the potential for unfair competitive advantage within the gambling markets.
While this new ruling from the ECJ has hit different regulators pretty hard, it was especially tough on Italian regulators. However, the European Gaming and Betting Association’s Secretary General, Sigrid Ligne, said that the ECJ’s ruling is a positive one. Furthermore, she also applauded the ECJ for requesting that the European Commission enforce the new law.
